Nope they can't. Player can go to FIFA for that and will get redressal. AIFF has already agreed that players currently in contract can't be part of ISL draft. So guys like Lobo Arnab and quite a few others at EB, will have to look at their current clubs for a loan release to ISL. Whatever I have heard, EB isn't really interested in loaning out in contract players unless they actually offer a buyout where the club makes money.

Kolkata: Indian football gets a new tumble as the newly given road-map by The All India Football Federation is now at further doubts on its implementations. The way things are approaching at the moment, it seems that there might be just the ISL this season and not the I-League and Champions League. Though the prediction is still speculative but the way things are getting complicated, it is becoming tougher for the other leagues to happen. The latest comments from the AIFF Secretary Kushal Das to www.xtratime.in , are enough to put further doubts on the future of the two clubs like East Bengal and Mohun Bagan. Kushal said, “We are not bothered about East Bengal and Mohun Bagan. Our concern is to think about Indian football. If the two Kolkata clubs decide to skip the tournament, we will think to be the ideal one for the benefit of Indian football, they may do that. That’s not our problem.”
At the same time the AIFF Secretary also said, “Yes we gave a proposal to the clubs on last Saturday. But I don’t know why the clubs are denying the fact that we told them that we would be consulting with the FSDL. I can remember that the President at least told five times that he would be discussing the matter with the FSDL. I don’t know why they are denying that right now.” He added, “I had a word with the FSDL. They said it will be difficult to run three leagues in a season. I will speak with AFC and lets see what they think about it. They might take this matter to the competition department and then might ask me to go down to their office.”
The comments from the AIFF Secretary have certainly made the Kolkata clubs and IFA annoyed. Dr Shanti Ranjan Dasgupta told www.xtratime.in , “The AIFF is a puppet. Mr Kushal Das knows nothing about Indian football and the entire federation is sold out to The IMG-R. It’s not only about us. All the members in the meeting know the truth. The AIFF is destroying Indian football. If they plan to run Indian football without the two historic clubs, they should be prepared for all the unpleasant circumstances from now on.”
Mohun Bagan Assistant Secretary Srinjoy Bose told, “We wanted the minutes of the meeting. FSDL was not there in the meeting. Who are they to discuss about it when the proposal came from the AIFF President? Does that mean that the credibility of the President has now been reduced to FSDL?”, he added, “The AIFF Secretary is saying that we are not telling the truth. Forget about us, there were the Churchill Brothers representative, the Shillong Lajong representative and The IFA Secretary himself. Do they want to say that the IFA Secretary is a liar?”.
Listening to the entire matter the IFA Secretary Utpal Ganguly said, “If the FSDL has more power than the AIFF President, I should better be silent. I will again discuss with the two clubs and send the reply to the Federation.”
With BJP joining the plot in Kolkata, this would become interesting. Would the CM allow BJP to get the Kolkata Big 2 what she couldn't? Let the two parties compete trying to get a deal for EB MB. Had enough of that NCP bastard ruining the game in the country.
BJP and Reliance Group are made for each other- close buddies. What do MB EB want and they can get for them? BJP will never do anything against ISL which is Reliance product.
According to Patel's proposal, top eight teams from both the leagues will play in a separate competition from where the top two teams will play in the AFC Champions League play-offs and the AFC Cup.
But for that to happen, a minimum of 14 matches needs to be played among the eight sides.
It has been learnt that Football Sports Development Limited (FSDL) -- the organisers of the ISL -- is also not with the AIFF on this proposal.
If the top four teams take part in the proposed new competition, I-League clubs will get a shot at representing Asia from India without paying the franchise fee, a sum ISL clubs will have to cough up.
Or they could play a Copa del ray like Cup competition with teams from the two leagues scheduled within the league duration itself as in Europe. Let the finalists take the AFC slots.
I-League clubs should make sure that the I-League champions get the ACL spot instead of getting into this Super Cup nonsense. Only that would maintain the top tier status of IL and something that may give them some bargaining power in future. Going after all these fake proposals is only making the IL weaker. Create pressure on AIFF for the good management of IL instead of hankering after this Super Cup shit. Do not dilute the two leagues, because only if there are two leagues AIFF will be forced to think about a merger in future. Otherwise somehow they will find a way to make the IL obsolete and have both AFC spots for ISL
The AIFF proposal is horrendous. Two leagues which have 18 matches each (ISL maybe with a few more for finals) should be easily done in five months (November to freaking April).
Do what @atuljg proposed and actually have a domestic cup weaved into the Indian domestic cup, why we don't do that is beyond me.
Also, unpopular opinion, I don't care for the SAFF Championship. Would rather send a U23 side there and instead schedule some friendlies in the summer or, you know, actually go with the proposed Champions Cup to get some proper opposition for the national team.

Just follow what was proposed in the plan except giving top tier status to Isl for keeping il clubs happy .
