A draft isn't only just for including new players. MLS and now the NHL (ice hockey) will use hold an "Expansion draft". This draft is only conducted when a new team enters the league and they need players in order to be competitive. Usually, the teams already in the league will be able to protect a certain number of players and the players they don't protect can be selected by the new expansion team.
Personally felt that could have worked here in the ISL but whatever, I am not against this one time draft but do feel that the league could have allowed teams to retain more players than just 2... at least 6 if that is the number of Indian starters we will have. Also the FPAI have their reasons for not liking the draft but will paint it as a "for the players" type thing.
Salary cap makes more sense than a draft I feel, players need to have a say in this situation too. Can't imagine Sunil playing for Kerala blasters. Or Udanta losing out on a training regime that's working for him.
You can have both. Just make it a rights thing. So if Jamshedpur's ISL team drafts in Jayesh Rane for example they haven't signed him yet but they have his rights... meaning they are the only franchise that can give him an offer. He can then negotiate a contract with them. If they don't come to an agreement, Jamshedpur can trade Rane's rights to another ISL team for compensation or another player on a different team who doesn't sign a deal. The draft would basically just calling dibs on a player.
That is how it is in MLS with the normal college draft. Players drafted are not given a contract automatically.
It's same in here. With players fearful of missing out, their agents started calling up the owners and offered 'cut money' to get their players during season 1 draft intermission
